This Privacy Policy applies to information Wing Aviation LLC and its subsidiaries (“Wing,” “we,” or “us”) collect about you when you use our websites, mobile applications, and other products and services that link to this Privacy Policy (collectively, the "Services") and when you contact or otherwise interact with us. Our Services include, for example, services we provide in connection with the operation of drones, including air space-related information and drone traffic planning services (collectively, “OpenSky Services”) as well as delivery services provided by Wing’s drones, which may be fulfilled through orders submitted through our Services or other parties. Our Privacy Policy does not apply to the data practices of companies or individuals other than Wing, including companies you may transact with through our Services.

Information we collect
The information we collect about you depends on how you interact with us. In this section, we describe the categories of information we collect and the sources of this information.
We collect information in the following ways:
Information You Provide to Us: We collect information you provide directly to us. For example, we collect information when you create an account, participate in any interactive features of the Services, fill out a form, provide feedback, participate in a contest or promotion, communicate with us via third party sites, request customer support, or otherwise communicate with us. The types of information we may collect include your name, email address, postal address, phone number, delivery information, and any other information you choose to provide. For OpenSky Services, we collect information you provide about your pilot or organizational license (such as issue and expiration date and license number), the drone you are operating, and your proposed flight destination and plan.
Information We Collect Automatically Through the Services: When you access, use, or otherwise interact with our Services, we automatically collect certain information, including:
Device Information: We collect device-specific information, such as a unique application number (if applicable to the Services you are using), your hardware model, operating system version, unique device identifiers, and mobile network information including phone number.
Transactional Information: When you request a delivery through our delivery mobile app, we collect information about the transaction, such as the items ordered, merchant details, package details, purchase price, date, delivery destination, and other similar order details.
Log Information: We automatically collect and store certain information in server logs. This includes details of how you use our Services (including search terms you enter and the results), IP address, device event information (such as crashes), system activity, hardware settings, browser type, browser language, the date and time of your request, and referral URL.
Information about Your Drone and Flights: If you choose to connect your drone to a device while you are using our OpenSky Services, we may collect information about your drone, such as your drone’s serial number and model information. We may also collect information about the flight destination you selected, the flight plan generated, your drone’s location, and information about your past flights (e.g., logbook information).
Cookies and Similar Technologies: We and our service providers use cookies, pixels, and other tracking technologies to collect and store information about your interactions with our Services and marketing communications. These technologies help us improve our Services and marketing communications, personalize your experience, and analyze your interactions with us, including to see which areas and features of our Services are popular and count visits. They also allow us to recognize and alert you if you leave items in your shopping cart. Images: Wing drones use low-resolution cameras in our navigation systems to confirm terrain data and for safety purposes. These cameras capture overhead images when fulfilling deliveries, which may incidentally include low-resolution black-and-white images of individuals or other objects within the field of view of our drones. For delivery services ordered directly through Wing, in limited instances we may associate these images with the Wing account of the user that requested the delivery, such as to confirm the delivery location and, in rare cases, to identify the individuals captured in order to enforce Wing’s policies.
Note on Geolocation: Our mobile apps may request permission to access precise geolocation from your mobile device. Where this occurs, this information is not collected by Wing and is instead designed to remain on-device and used only within the app.
Information We Collect From Other Sources: We may also obtain information from other sources, including:
We may collect information about you from our third-party social media channels if you choose to engage with these channels. If you log into our Services through your Google account, we will have access to limited profile data (such as email address, phone number, name, and profile picture associated with your Google account).
In connection with our delivery Services, if you place an order with one of our retail partners and not directly through our Wing app, we may receive information from our retail partners, such as the name and phone number of the dropoff recipient, delivery address and location coordinates, order ID, and details regarding items purchased (e.g., weight, size).
In connection with certain OpenSky Services, we may collect information about you from:
Participating third parties who provide remote identification services. The information we collect from them is similar to the information described above about your drone and flights. If you are located in the US, drone and flight information may be collected from approved UAS Service Providers (USP) and Wing will retain such data until you choose to delete it.
Other providers of aviation-related services and their users, such as disclosing airspace information about your proposed flight with other UAS Service Providers or Air Navigation Service Providers in order to detect conflicts.
Information We Derive: We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your IP address.

Payment information
If the Services require payment, you may need to provide your credit card information directly to our third party payment processor or through a third party’s website to which the Services link. This information will be governed by the third party’s privacy policy and terms of service.

How we use information we collect
Wing uses the data we collect in the following ways:
Provide, maintain and improve our Services and develop new ones.
Help us solve any issues you may have with the Services, respond to your comments and questions, and provide customer service.
Send you technical notices, security alerts, support messages, and other transactional or relationship messages, including confirmations, receipts, and invoices.
Send you marketing communications (see the Your choices section below for information about how to opt out of these communications at any time).
Personalize your user experience.
Target advertisements to you on third-party platforms and websites (for more information and to opt out, see the Targeted advertising and analytics section below).
Monitor and analyze trends, usage, and activities in connection with Services.
Comply with any applicable law, regulation, legal process or enforceable governmental requests.
Enforce applicable terms of service, including investigation of potential violations.
Detect, investigate, respond to, prosecute, and help prevent, or otherwise protect against security incidents and other malicious, deceptive, fraudulent, or illegal activity.
Protect against harm to the rights, property, or safety of Wing, our users, or the public as required or permitted by law.
Carry out any other purpose described to you at the time the information was collected.

Information we disclose
We disclose information about you as described in the Targeted advertising and analytics section and in the following scenarios:
Vendors and service providers: We permit vendors, service providers, contractors, and consultants to access information to perform services for us, such as companies that assist us with web hosting, shipping and delivery, payment processing, fraud prevention, customer service, and marketing and advertising.
Third-party business partners: We disclose personal information to merchants and delivery partners when you use our Services to request a delivery.
With your consent or at your direction: We disclose personal information to companies, organizations, or individuals outside of Wing when we have your consent or if you have directed us to do so.
Integration partners: If you choose to use third-party integrations we offer on our Services we provide certain information to the integration partners.
Related companies in our group: We disclose personal information to our subsidiaries and, in more limited instances, to our parent company and affiliates (other companies in our group of companies under common control and ownership).
To protect the rights of Wing and others: We may disclose personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Wing, our users, the public, or others.
Professional advisors: We disclose personal information to our legal, financial, insurance, and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
Corporate transactions: We disclose personal information in connection with, or during negotiations concerning, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
For legal and security reasons: We will disclose personal information if we have a good-faith belief that such disclosure is reasonably necessary to comply with any applicable law, regulation, legal process, or enforceable governmental request; enforce applicable terms of service, including investigation of potential violations; and detect, prevent, or otherwise address fraud, security, or technical issues.
We also disclose aggregated or de-identified information that cannot reasonably be used to identify you. For example, we may disclose aggregated information to show trends about the general use of our Services. We maintain and use this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.
In connection with our OpenSky Services, we also disclose your information as follows:
When you use the Services to register your drone, authorize your flight, apply for a license, or request access to controlled airspace from an aviation or other government authority, we disclose your information to that government authority, including contact information, information about you or your company (e.g., operator license number), information about your drone (e.g., registration and serial number), and your proposed flight plan (e.g., start time, duration, operation area, and maximum altitude).
We disclose information to other providers of aviation-related services, including unmanned traffic planning services, to provide or enable our Services and detect potential conflicts.
We disclose certain information to government authorities for remote identification purposes, when required to do so. In jurisdictions where this is required, we will disclose your information to the applicable government authority or provider authorized by the government authority, such as other remote identification service providers. This information could include your name, contact information, license information, drone serial number and other drone identifiers, your user ID, and details of your flight (e.g., location, time, and speed). This information will be shared with approved UAS Service Suppliers and relevant member state regulators.

Your choices
Account information
You can access, correct, and delete certain information stored within your Wing account by logging in and navigating to the Settings menu in our mobile apps. You may also export certain profile and usage data related to our delivery service by visiting https://takeout.google.com.
Precise location information
When you first launch any of our mobile apps that collect precise location information, you will be asked to consent to the app’s collection of this information. As noted above, this processing is designed to occur only on-device through the app itself. If you initially consent to this collection of precise location information, you can subsequently stop the collection of this information at any time by changing the preferences on your mobile device. Please note that changing this setting could affect the functionality of our mobile apps and your ability to get deliveries.
Cookies and similar tracking technologies
Wing uses cookies and similar tracking technologies, as described above. You can usually adjust your browser settings to remove or reject browser cookies. You can also adjust certain cookie settings by clicking on the Your Privacy Choices link in the footer of our website. Your device may also include a feature that allows you to opt out of having certain information collected through mobile apps used for behavioral advertising purposes. Please note that removing or rejecting cookies could affect some of the functionality of our Services, such as remembering your preferred language.
Communications preferences
You may opt out of receiving promotional emails from Wing by following the instructions in those communications. If you opt out, we may still send you non-promotional emails, such as those about your account or orders.

Individuals residing in certain U.S. states
Some U.S. states have enacted privacy laws that grant their residents certain rights and require specific disclosures. If you are subject to these laws in Texas or California (“State Privacy Laws”), this section applies to you and also serves as our California notice at collection.

Use and disclosure of personal information for business purposes
Additional use and disclosure of personal information for business purposes for OpenSky users:
Identifiers, such as name, company information, operator license number, and information about your drone; and
Activity information, such as projected flight plan (e.g., start time, location of the drone’s flight, duration, operation area, and maximum altitude, speed).
Regulatory and government authorities; and
Third parties such as providers of aviation-related services.
To provide the OpenSky services (e.g., to enable you to register your drone, authorize your flight, apply for a license, or request access to controlled airspace from an aviation or other government authority);
When required to provide or enable similar services (e.g., in areas where multiple providers of aviation-related services, including unmanned traffic planning services, are permitted, we will share disclose information about your proposed flight with such service providers in order to detect conflicts); and
If government authorities require that Wing provide your drone and operator information for remote identification purposes, we will disclose your information to the applicable government authority or provider authorized by the government authority, such as approved UAS Service Suppliers.
If we collect information that is considered “sensitive” under State Privacy Laws we only do so with your consent. We do not use or disclose sensitive personal information for the purpose of inferring characteristics about you.
As described in the Information we collect section above, we collect personal information from various sources, including directly from you, automatically when you access or use our Services, and from third-party sources. We retain personal information as described below in Data retention.
Sales, sharing, and targeted advertising activities
We disclose certain categories of personal information to third parties to show you targeted ads on third-party properties and understand the effectiveness of this advertising. These disclosures may be considered “sales” or “sharing” or use of personal information for “targeted advertising” under State Privacy Laws, and the table below provides more information about our practices.
We do not engage in sales, sharing, or targeted advertising using personal information about consumers we know to be under the age of 18.

Cookies and Similar Technologies: Following the prompts behind the Your Privacy Choices link in the footer of our website. Your opt-out choice will be linked to your browser only; therefore, you will need to renew your opt-out choice if you visit our website from a new device or browser, or if you clear your browser’s cookies. For our mobile app, you can opt out by adjusting your device settings to turn off app tracking.
Other Identifiers: Filling out our web form to turn off activities that may be considered “targeted advertising,” “sharing,” and “sales” that are based on your email address and other non-cookie identifiers.
You can also opt out by visiting our websites with a legally recognized universal opt-out signal enabled, such as the Global Privacy Control.
Access, correction, and deletion
You have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information.

Nondiscrimination
You have the right not to be discriminated against for exercising any of your privacy rights.

If we deny your request, you may appeal our decision by notifying us through our web form. Please select “other” and explain the reason for your appeal. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.
Authorized Agents
If you are an authorized agent seeking to make a request to opt out of sales, sharing, or targeted advertising on behalf of a consumer, please fill out this web form.
If you reside in California, you may also designate an authorized agent to submit an access, deletion, or correction request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may contact the individual who is the subject of the request to verify their own identity or confirm the authorized agent has permission to submit the request. Legal basis for processing
If you reside in the European Economic Area (EEA), Switzerland or the UK, we process your personal data as described in this Privacy Policy in reliance on the following lawful bases:
To perform our responsibilities under our contract with you (e.g., processing payments for and providing the services you requested);
To comply with our legal obligations (e.g., to maintain a record of your consents and track those who have opted out of marketing communications);
When we have your consent to do so (e.g., when you opt in to receive marketing communications from us). When consent is the legal basis for our processing of your personal information, you may withdraw such consent at any time; or

Processing of Information in the United States and other countries
Wing stores personal information on our servers in many countries around the world, including the United States and Australia, Finland, Ireland, Singapore, and the United Kingdom. Data protection laws vary among countries and the laws of some countries may provide a different standard of protection than under the laws of your country. We will take steps designed to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it. Where required by law, we provide adequate protection for the transfer of personal data in accordance with applicable law, such as by obtaining your consent, relying on the European Commission’s adequacy decisions, or executing Standard Contractual Clauses. Data retention
We retain personal information for different periods of time depending on what it is, how we use it, and how you configure your settings. Some data you can delete or update whenever you like, such as your pilot license in OpenSky or your address and phone number for delivery services. Other data is deleted or anonymized automatically after a set period of time, such as application usage analytics, which we delete after no more than 460 days. We keep some data until you delete your Wing Account, such as information about how often you use our services. And some data we retain for longer periods of time when necessary for legitimate business or legal purposes, such as security, fraud and abuse prevention, complying with legal or regulatory requirements or financial record-keeping.
